“ให้รัฐภาคีแต่ละรัฐต้องประกันว่า
เจ้าพนักงานที่อ้างถึงในวรรค 1 ของข้อนี้

(a) มีอำานาจและทรัพยากรที่จำาเป็นที่จะ
ดำาเนินการสืบสวนอย่างมีประสิทธิภาพ
รวมถึงการสามารถเข้าถึงเอกสารและ

ข้อมูลอื่น ๆ ที่เกี่ยวข้องกับการสืบสวน

(b) สามารถเข้าถึงสถานที่กักขังหรือ

สถานที่ใด ๆ ที่มีเหตุอันควรเชื่อได้ว่า
บุคคลที่หายสาบสูญอาจอยู่ ณ ที่นั้น
โดยได้รับการอนุญาตล่วงหน้าจากศาล

ซึ่งต้องดำาเนินการอนุญาตโดยพลัน” 441

“3. Each State Party shall ensure that the authorities referred to in
paragraph 1 of this article:
(a) Have the necessary powers and resources to conduct the investigation
effectively, including access to the documentation and other information
relevant to their investigation;
(b) Have access, if necessary with the prior authorization of a judicial
authority, which shall rule promptly on the matter, to any place of detention
or any other place where there are reasonable grounds to believe that the
disappeared person may be present.”
