2.3 การใช้ถ้อยค�า “บุคคล” “ชุมชน” และ “ประชาชน” ในฐานะ

เป็นที่สังเกตได้ว่าบทบัญญัติที่เกี่ยวข้องกับสิทธิเสรีภาพของพลเมืองใน
รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 รวมถึงการก�าหนดหน้าที่ของรัฐ

ซึ่งมีความสัมพันธ์กับสิทธิเสรีภาพของพลเมือง มีการใช้ถ้อยค�า “บุคคล” “ชุมชน”
และ “ประชาชน” ในหลายจุด จึงเป็นประเด็นที่ต้องพิจารณาต่อไปว่านัยของการใช้

ถ้อยค�านั้น ต้องการความหมายที่แตกต่างกันไปหรือไม่ ตลอดจนค�าว่า “ชุมชน”
ที่ปรากฏในมาตรา 41 และมาตรา 43 ที่บัญญัติใช้คู่กับค�าว่า “บุคคล” เป็นค�าว่า
