(4) Reengineer participation and environmental justice systems.
It is necessary to make revisions in two important systems:
the Environmental Impact Assessment (EIA) system and the justice system.
The EIA system is meant to establish justice from upstream before
any policy or project is implemented, while the justice system serves
as the destination for problem resolution, including complaint processes
by administrative agencies such as the General Administrative Department
and the Administrative Court. This latter process is deemed as important
as the administrative process of participation from the beginning as it can
ultimately retrieve the origin of justice.
(5) Strengthen people's rights and participation. When the public
sector is empowered, they can effectively express their rights and
participate in ways that the government will accept. One important mechanism
for achieving this is the gathering of people and decentralization
of the management of natural resources and the environment to local
administrative organizations. Environmental justice can be achieved
by establishing community rights, reducing the government's power,
and allowing the community to play a more significant role. It may
also be necessary to create a mechanism for community involvement
in environmental matters.
