3.3 An emergency decree is considered when it is enacted
by the King in accordance with the recommendation of the Cabinet
of Thailand in accordance with Section 172 of the Constitution,
which stipulates the duty of the Cabinet of Thailand to bring that
Decree into consideration for approval or disapproval from the
National Assembly. Therefore, roles and duties for consideration of
Emergency Decree are a part of the senators remit.
4) Duties of the Senate to present opinions on various issues
4.1 Giving opinions for appointment of a Prime Minister
during the first five years term according to the Constitution that
requires the National Assembly to approve the suitable person
to be appointed as the Prime Minister to proceed in accordance
with Section 159 unless the consideration of approval is under
Section 159 paragraph one to act at a joint meeting of the National
Assembly, and an approved resolution under Section 159 paragraph
three must be voted on by more than half of the total number of
the existing members of both Houses (Section 272).
4.2 Duty to provide advice on the selection and
appointment of holders of various important positions as follows:
4.2.1 Approval for the appointment of selected or nominated
persons for the position of “Justices of the Constitutional
Court” (Section 204, last paragraph).
