the common law while government agencies and networks should lead
a restorative justice process for a sustainable transition.
The summary of the analysis in the cases of political injustice
from prosecuting political protesters suggested the authorities imposed
the law and the justice process as tools to stop political movements,
eliminate players in different political sides, create fear, and make
abnormal procedures. The catalyst for the social crisis in this case started
with the Constitutional Court’s decision on 10 November, 2021 that the
rally and speeches by demonstrators at Thammasat University’s Rangsit
Campus in 2020 were meant to overthrow the democratic regime with
the King as Head of State according to the Constitution. This important
"cutting line" causes more conflict and division in society. An important
suggestion is that the authorities must stop using the law and the judicial
process to eliminate political players with different political views, but
open forums for discussion to find creative solutions, such as parliamentary
mechanisms that adhere to the public interests.
From the results from the study, the researchers propose structural
reform of Thailand’s criminal investigation system and to administration
within the police organization in order to reduce the gap in discrimination
against the accused in criminal cases. Three reforms are suggested.
