EXECUTIVE SUMMARY
The objectives of this research are to study and propose certain legal mechanisms to
strengthen citizenship for performing civic duties under the Constitution of the Kingdom of
Thailand B.E. 2560 (2017), and to study and propose other related tools and measures for a
balance between the performance of civic duties and the exercise of rights and liberties
under the Constitution of the Kingdom of Thailand B.E. 2560 (2017). This study was
conducted by the qualitative approach based on the documentary research. The results and
suggestions of this study were described below.
1. Results
1.1 Constitution of the Kingdom of Thailand B.E. 2560 (2017) and civic duties
based on 6 citizenship frameworks. According to 6 citizenship frameworks, which consist of
self-responsibility and self-reliance, respect to the principle of equality, respect to
differences, respect to other people’s rights, respect to rules, and social and common
responsibility, it was found that most of the said citizenship frameworks have been already
imposed in the present Constitution of the Kingdom of Thailand as specified below.
(1) Provision of some main principles, e.g. respect to rights of other people as
imposed in Section 50(6) and Section 25, and respect to rules as provided in Section 50(3).
(2) Provision of minor issues, e.g. self-responsibility and self-reliance with the
issue of enrollment in compulsory education as imposed in Section 50(4), respect to
differences and the issue of respecting different views of another person as imposed in
Section 34, paragraph two and Section 258 a. Politics (1) social and common responsibility
with issues of protecting and upholding the Nation, religions, the King, and the democratic
regime of government with the King as Head of State (Section 50(1)), defending the country,
protecting and upholding honor and interests of the Nation, and public domain of State, as
well as cooperation in preventing and mitigating disasters (Section 50(2)), serving in armed
forces (Section 50(5)), freely exercise of right to vote in an election or referendum by taking
into account the common interests of the country as prime concerns (Section 50(7)),
cooperating and supporting the conservation and protection of the environment, natural
resources, biodiversity, and cultural heritage (Section 50(8)), paying taxes and duties (Section
