Conclusions and Recommendations
Fair competition creates opportunities for economic development,
promotes innovation, strengthens the capabilities of SME business
operators, enables effective business competition, facilitates expansion
of businesses, reduces the issue of business concentration in Bangkok
and its surrounding areas, generates investment, increases employment
opportunities, improves income distribution, empowers business operators,
enhances the quality of products and services, provides people with
a wider range of options, and promotes purchases."
However, Thailand still maintains an economic and political
structure under undemocratic legal frameworks with limited roles for
relevant organizations in promoting fair competition. Issues related to
business and political interests persist as large companies influence
government decisions, exploit legal loopholes to seek business advantages
(often referred to as “rent-seeking”), and use their advantages in legal
knowledge to expand their business interests. Unfair trade competition
could potentially lead to more business mergers across the board in
the future if the legal and economic structures are not democratized to
foster a more competitive society.
The 2017 Trade Competition Act has undergone amendments and
has been in effect since 2017, but still lacks comprehensive and sufficient
provisions to regulate trade competition fairly. Furthermore, the trade
