7) Unlikelihood of the Private Sector Preventing Monopoly
in the Market
Since the enforcement of the 1999 Trade Competition Act and
subsequent 2017 Trade Competition Act, there has never been a single
legal action or trade competition case brought to the attention of the
Court of Justice. The law makes the elements of legal action too difficult
and does not allow the private sector to file a case to prevent monopoly
on their own. The impacts on people's confidence in law enforcement
organizations are caused by losing courage in pursuing unfair conduct.
Business operators may take advantage of loopholes in trade competition
laws to limit competition or conduct business mergers to create
monopoly, probably affecting the overall economic system. Meanwhile,
the criminal trial process requires the court to consider the evidence to
eliminate doubt before sentencing the offender. Trials take a long time.
Therefore, it is not possible to solve the problem in a timely manner,
especially in the case of business mergers and acquisitions that may
cause widespread damage to the economic system.
