Causes, Effects, and Risks to Promote Fair Competition
According to the 2017 Trade Competition Act
1) The legal issues include: (1) the lack of necessary criteria or
guidelines for enforcement, mostly relying on discretion; (2) exemptions
for state enterprises with public utility services; (3) penalties to prevent
misconduct; and (4) inefficient law enforcement by regulatory
organizations. Other factors in addition to the law include: (1) no experts
or personnel knowledgeable in economics, law, and trade competition;
and (2) the lack sufficient experience in considering cases related to trade
competition since no trial concerning trade competition has resulted
in a clear decision for prosecution.
2) The hidden factors include: (1) untimely and relevant
laws of Thailand to economic conditions; (2) no regulatory agency, no
independence of the Trade Competition Commission, and no concrete law
enforcement; (3)inequality in understanding trade competition laws and
other related laws among all large businesses and small entrepreneurs;
(4) no concrete regulatory impact assessment; (5) political connected
structure with Thai economy; and (6) the incomprehensible, unclear written
structure of trade competition criteria prevents practical enforcement.
