in a position, abusing power in their position to cause harm, and dishon-
estly performing or refraining from duties;
(3) collaborating in killing others by torture or by committing
cruel acts;
(4) collaborating with five or more individuals to induce others to
commit an act, or to refrain from doing something or yielding to something.
Later, on June 8, 2022, the Central Criminal Court for Corruption
and Misconduct issued a verdict in the case by ruling that Pol. Col.
Thitisan Utthanaphol and the defendants No.1-5 and No.7 committed
the offenses alleged in the complaint. The single killing violated many
laws, namely, Section 289 (5) for killing a person intentionally and
committing it through torture and cruelty, and Section 90, warranting
the death penalty. Defendant No.6 was found guilty under Section 157 of
physically forcing someone to do something, and neglecting to perform
his duties, and was sentenced to 8 years in prison. The defendants No. 1-7
pleaded to serve facts to the trial, provide a fund for funeral expenses,
relieve ill effects from the parents of the deceased, provide first aid and
transferral to the hospital resulting in his retrieved vital sign. Therefore,
the sentence for each defendant was reduced to 1 in 3. The defendants
No. 1-5 and No. 7 remain in prison for life. The defendant No. 6 received
the remaining sentence of five years and four months.
