1.3 Justice process: investigation of criminal cases
in order to provide justice to society
Issues in the Criminal Investigation System
Critical issues of the criminal investigation system are affecting
a crisis of faith and confidence in society. The role of the foundation in
justice in society profoundly impacts victims, the accused, the defendants,
and the public. Furthermore, abuse of power or corruption within the
criminal investigation system undermines the fundamental principles
of rights and liberties. These principles are considered the most crucial
aspects of human rights within the context of a civilized country and are
at the core of the rule of law. The rule of law, often referred to as the
guarantee of basic rights in criminal cases, ensures that individuals will
not face criminal punishment unless they have committed an offense for
which the law prescribes a penalty. It also guarantees the right to easily,
conveniently, and promptly access the justice process and ensures that
each case is considered fairly and expeditiously (Atthaphon Yaisawang,
2014, pp. 1-2).
