3.3.1.2 ผู้บังคับบัญชา

นอกจากบุคคลที่เป็นผู้กระทำาผิดหลักและบุคคลที่มีส่วนเกี่ยวข้องกับ

การกระทำาของผู้กระทำาผิดหลักจะมีความรับผิดทางอาญาภายใต้อนุสัญญาแล้ว
อนุสัญญา CED ยังได้กำาหนดให้ผู้บังคับบัญชาอาจมีความรับผิดทางอาญาด้วย

หากมีพฤติการณ์เข้าเงื่อนไขตามที่อนุสัญญากำาหนด ซึ่งหลักการเรื่องความรับผิด
ทางอาญาของผู้บังคับบัญชานี้ เป็นหลักการที่ปรากฏเฉพาะในอนุสัญญา CED
โดยได้รับอิทธิพลมาจากธรรมนูญกรุงโรม โดยอนุสัญญา CED ได้กำาหนดไว้

ในข้อ 6(1)(b)-(c) ดังนี้

and liable for punishment for a crime within the jurisdiction of the Court if

Commits such a crime, whether as an individual, jointly with another or
through another person, regardless of whether that other person is criminally
