2. บราซิล กำาหนดให้การกระทำาของผู้บังคับบัญชาที่ได้ใช้อำานาจ
ความรับผิดชอบอย่างมีประสิทธิภาพสำาหรับและเพื่อควบคุม

กิจกรรมซึ่งเกี่ยวข้องกับการกระทำาให้บุคคลสูญหาย ปรับใช้กับ
เหตุที่ทำาให้ต้องรับโทษหนักขึ้น (Aggravating Circumstances)

กฎหมายอาญาบราซิล มาตรา 62 วางหลักว่า ผู้ที่กระทำาการ
ดังต่อไปนี้ต้องรับโทษหนักขึ้น กล่าวคือ 1) ส่งเสริมหรือจัดให้มี

ความร่วมมือในการกระทำาความผิด หรือกำากับการทำากิจกรรม
ของผู้กระทำาความผิดรายอื่น 2) ข่มขู่หรือจูงใจอย่างมีนัยสำาคัญ
ให้ผู้อื่นกระทำาความผิด 3) ยุยงหรือสั่งการให้ผู้อื่นที่อยู่ภายใต้

อำานาจให้กระทำาความผิด 4) ให้คำามั่นว่าจะให้รางวัลหรือสินจ้าง

หากมีการกระทำาความผิด ซึ่งเป็นการกำาหนดความรับผิดทาง
อาญาของผู้บังคับบัญชาที่กระทำาการเข้าข่ายเหตุเหล่านี้ในฐานะ
ที่เป็นเหตุที่ทำาให้ต้องรับโทษหนักขึ้น

the commander or superior officer who gave the order may be punished as
the indirect perpetrator of the offence.”
