4.1.1 หน้าที่ของรัฐในการป้องกันมิให้เกิดการกระท�าความผิด
ในเขตอ�านาจของตน
อนุสัญญา CAT และอนุสัญญา CED ต่างกำาหนดให้รัฐภาคีมีหน้าที่
ต้องป้องกันมิให้เกิดการกระทำาความผิดในเขตอำานาจของตน ดังนี้

“ให้รัฐภาคีแต่ละรัฐดำาเนิน “บุคคลจะถูกบังคับให้หายสาบสูญ
มาตรการต่าง ๆ ทางนิติบัญญัติ ทาง ไม่ได้” 235

อนุญาต การสนับสนุนหรือการยอมรับ
โดยปริยายจากรัฐ และนำาตัวผู้ที่ต้อง
รับผิดชอบมาดำาเนินคดี” 236
