the people and community that want to take legal proceedings against the State agency,
but such conditions and procedures seem complicated, and all procedures must be
completed before filing the lawsuit to the Constitutional Court. To make Section 51 tangible,
Section 45 of the Organic Act on Procedures of the Constitutional Court B.E. 2561 (A.D. 2018)
should be amended by shortening the time period and the procedures to be done by the
people while increasing the sanction for any related State agency so that the people and
the community get benefit in their rights and liberties.
(2) The State should have a role in supporting the civil politics by supporting the
establishment of an organization with a duty of publicizing, educating, or arousing awareness
of people regarding their rights, liberties, and duties. This organization may be in the form of
fund or foundation in which the people can take actions in its operation. The government
sector will provide the support in the form of subsidy only without any intervention so that
the people will be actually involved in such operation. It may be required by law that such
found or foundation may request for cooperation from any political parties, either subsidy or
personnel, to do certain activities for the public by educating the general people about
rights, liberties, and duties of the people in order that such organization is an actual civil
organization and it will not take side with any political party. To promote the people to be
aware of their rights, liberties, and duties, and to be involved in the civil politics under the
State’s support, a specific law should be enacted to support the establishment of this
political organization with the State’s subsidy as an alternative for the people who want to
take part in politics, and to provide knowledge to the people by indiscriminating the political
party.
(3) Although, at present, the law imposes that the State, by the Office of the
Election Commission, shall subsidize the political parties through the Fund for Development
of Political Parties to enable them to carry out the political activities, most of these political
parties have never developed themselves to be the political institution promoting and
developing the democratic regime. Previously, it appeared that some small political parties
whose candidates were not elected and these parties were exploited by their administrators
as these small political parties have never arranged any political activities, but the State has
lost some budget. Therefore, the existing legal measures and mechanisms used to examine
the political parties’ spending of budget as supported by the State should be revised. If any
