= Types of public services suitable for the form of a Local Public Enterprise or Social
Enterprise
= Level of Profits Considering types of public services in the form of Local Public
Enterprise and Social Enterprise is to make the operation the most effective. The
maximum profit is not restricted in some public services in line with market forces and
competitive with the private sectors (such as land rent to the private sectors) while
some types of public services are restricted in the pursuit of maximal profit because
of public interest (such as bus fees).
= Prospective Customers or Members of Public services Considering that types of
public services in the form of Local Public Enterprise and Social Enterprise is to
identify the targeted group of customers or members whether they are specific groups
(disabled, low-income women, children, etc.), or all groups.
= Compatibility between types of public services and Local Public Enterprise/Social
Enterprise. The Local Public Enterprise and Social Enterprise are different in the
objective of the organization and operation such as funding process and profit
exploitation. If the types of public services require a lot of funding through the market
system, gains a lot of profits, or emphasizes highly on business, the enterprises may
be conducted in the form of corporate instead of foundation. If the enterprise requires
the nature of the equal involvement from stakeholders, the cooperative is suitable
since the members of the organization can vote equally unlike corporate that the
number of votes depends on the number of the shares.
Findings regarding the Local Public Enterprise and Social
Enterprise of the Local Government in Thailand
Local governments in Thailand have the authority to precede the Local Public Enterprise
compatible with the legislation as the follows: 1) the Provincial Administration Act 2540,
section 50; 2) the Municipality 2496, Section 51 (9), Section 54 (12), Section 57,
Section 57 (bachelor) and Section 61; 3) The Council and Subdistrict Administrative
Organization Act 2537, Section 68 (11); 4) Bangkok Administration Act, 2528, Section 97
(3) of section 99 (5); 5) Pattaya City Administration Act, 2542, Section 62 (12), Section
64 and Section 70; and 6) the Plan and the Process of Decentralization to Local
Governments 2542, Section 16 (7), Section 17 (15), and section 18.
The Social Enterprise can be operated in two ways: 1) the Cooperative Form
compatible with the Act 2542; 2) the Foundation Form compatible with the Civil and Local
