< There is a conflict between the laws on the establishment of a new entity
and the Local Public Enterprise investment by local governments.
Although the Provincial Administration Act, 2540 B.E, does not allow the
Provincial Administration to establish the new entity, the Regulations of
Ministry of Interior on the Local Public Enterprise operation of the
Provincial Administration, 2541 B.E allow investment in Local Public
Enterprises in a newly formed entity.
2) Local government’s potential to run Local Public Enterprises and Social
Enterprise includes:
= Types of Local Public Enterprises and Social Enterprise
Most local governments have operated Local Public Enterprises under the
management of their own structure because it is the most common form among
local governments. The operation has been going on for a long time and it can
be preceded immediately. As a result, the administration of these Local Public
Enterprises lacks flexibility and cooperation or joint venture with other local
governments or the private sectors.
Although the law does not prohibit local governments to operate Social Enterprise
for the community development, its implementation exists very little among local
governments. The operation in the form of Social Enterprise aims to resolve
obstacles from regulations of the local governments that are not conducive to
public services in order to improve mobility of the operation. However, it does
not directly facilitate the collection of the revenues for the operation of these
social activities. For example, the saving cooperative is established to collect
the capital and income in the form of dividends to local government officials
who are members.
= Creativity of “PUBLIC SERVICE” through Local Public Enterprise
According to the study, the types of local public services operate in the form of
Local Public Enterprise are confined to the common Local Public Enterprise
purposes such as slaughterhouse, water utility, wastewater treatment, and
pawn shop. Even though the laws allow municipalities to initiate other types of
Local Public Enterprises, the survey shows very few initiatives. The results of
the survey suggest that local governments operate market the most at the
number of 100 or 13.3 %; the second is Pawn Shop at the number of 97 or
12.9 %; the third is slaughterhouses at the number of 59 or 7.8 %; and the
fourth is the water utility at the number of 53 or 7 %.
