7. Local Public Enterprise and Social Enterprise can have an independent funding in
addition to that from the central government, but the funding must be consistent with
the form of Local Public Enterprises and Social Enterprise.
8. Local Public Enterprise and Social Enterprise are to meet the specific needs of the
targeted group and build up the local development.
9. Opportunity is provided to various sectors to create Good governance and corporate
governance in business, Local Public Enterprise and Social Enterprise.
2) Law
Thailand needs to amend the law to support the operation of Local Public Enterprise
and Social Enterprise in accordance with the following suggestions.
= The legislation defines the authority of local governments to provide public services
according to Local Capability or General Competence.
= The legislation and guidelines must be clear about “Compete with private Firms” in
two aspects:
< Legislation and guidelines defines principles and definitions for the interpretation
of “Compete with private Firms” for government agencies, public enterprises,
and local governments.
< Cancellation of privileges to create an advantage over the private sector in
competing with the government agencies, public enterprises, and local
governments.
= The amendment of the law articles on the establishment of Local Public Enterprise
by local government in every issue or legislation should include these 4 aspects:
< Types of public services that can be implemented in a Local Public Enterprise
< Forms and methods of establishing Local Public Enterprise
< Plan and strategy on the Local Public Enterprise operations for each local
organization
< Specialized agencies to supervise, monitor, and promote the operations of
Local Public Enterprise by local governments.
= Although initiatives of Social Enterprise by local governments can be operated under
the existing laws, additional laws, regulations or guidelines should be enacted to form
the relationship between local governments and Social Enterprise under the
supervision and direction of the local governments with good governance in two
aspects:
< Legislation or regulations to regulate the assignment, support or engagement of
social enterprises for the public services
