The situation and problems of the Local Public Enterprise and Social Enterprise in
Thailand are as follows:
1) Limitation of conducting Local Public Enterprises due to the interpretation of
laws and regulations including:
= The interpretation of the Act restricts the establishment of a Local Public
Enterprise by local governments. Although local governments have authority to
pass the law for the establishment or operation of a Local Public Enterprise in
the local government council, but the law must be approved by the Minister of
the Interior in the final stages such as the municipality under section 57 (TER)
of the Municipality Act. 2496 B.E and Bangkok Administration Act, section 93,
2528 B.E
= Limit on Types of Public Services in the Local Public Enterprise due to:
1) The law limits types of public services provided by local governments, as
defined in the Legislation on Local Government Establishment and the
Decentralization Act 2542 B.E, so there are certain types of public
services that local organizations cannot operate.
2) The interpretation of the law that allows a Local Public Enterprise to
perform certain types of public services such as “Utilities” limits the
scope of local public services that can be provided by local governments
despite the actual need of the service. Some local authorities are not
allowed to provide services they need. For example, Tambom
Municipality is not allowed to provide housing service to relieve slum
problems. The Municipal Act 2496 B.E only allows Muang Municipalities
and City Municipalities
