80 บทบัญญัติทางกฎหมาย เพื่อการป้องกันและปราบปรามการทรมานและการกระทำาให้บุคคลสูญหาย

จากคำานิยามนี้ แสดงให้เห็นว่า “การทรมาน” จะต้องประกอบด้วย
องค์ประกอบทั้ง 3 ประการ คือ

ต้องปรากฏ ต้องปรากฏ ต้องปรากฏ
ความเจ็บปวดหรือ ความ ความเกี่ยวข้อง
ความทุกข์ทรมาน มุ่งประสงค์ กับรัฐ
อย่างร้ายแรง

โดยแต่ละองค์ประกอบมีรายละเอียด ดังนี้

3.2.1.1 ต้องปรากฏความเจ็บปวดหรือความทุกข์ทรมาน

อย่างร้ายแรง

ความเจ็บปวดหรือความทุกข์ทรมานอย่างร้ายแรง (Severe Pain or
Suffering) เป็นองค์ประกอบที่ทำาหน้าที่แยกการทรมานออกจากการกระทำาอื่น ๆ
ที่ส่งผลกระทบที่รุนแรงน้อยกว่า โดยอนุสัญญา CAT ระบุว่าความเจ็บปวด

หรือความทุกข์ทรมานนั้น ไม่ว่าจะเกิดขึ้นต่อร่างกายหรือจิตใจ จะต้องมีลักษณะที่
“อย่างร้ายแรง” (Severe) ทั้งนี้ ในระหว่างการเจรจาได้เคยมีการเสนอให้ใช้คำาว่า

for an act he or a third person has committed or is suspected of having
committed, or intimidating or coercing him or a third person, or for any reason
based on discrimination of any kind, when such pain or suffering is inflicted
by or at the instigation of or with the consent or acquiescence of a public
official or other person acting in an official capacity. It does not include pain
or suffering arising only from, inherent in or incidental to lawful sanctions.

2. This article is without prejudice to any international instrument
or national legislation which does or may contain provisions of wider
application.”
