ผู้แทนที่เหมาะสมได้ เป็นพันธกรณีที่ใช้ในบริบทที่ผู้ถูกคุมขังเป็นคนชาติของรัฐอื่น
ที่ไม่ใช่รัฐที่จำากัดเสรีภาพหรือเป็นคนไร้สัญชาติ และสอดคล้องกับพันธกรณีภายใต้

(อนุสัญญา VCCR) ว่าด้วยการสื่อสารและการติดต่อกับคนชาติของรัฐผู้ส่ง

โดยอนุสัญญา VCCR กำาหนดให้คนชาติของรัฐผู้ส่ง (Sending State) สามารถ
ติดต่อกับเจ้าพนักงานกงสุลของรัฐผู้ส่งได้ และในกรณีที่เจ้าพนักงานกงสุล
ของรัฐผู้ส่งร้องขอมายังรัฐผู้รับ (Receiving State) เจ้าพนักงานของรัฐผู้รับจะต้อง

แจ้งให้เจ้าพนักงานกงสุลของรัฐผู้ส่งทราบโดยไม่ชักช้าเกี่ยวกับข้อมูลการจับกุม
คุมขังของคนชาติของรัฐผู้ส่ง ไม่ว่าจะเป็นสถานที่หรือสถานะของการคุมขัง รวมถึง

ต้องอนุญาตให้เจ้าพนักงานกงสุลของรัฐผู้ส่งเข้าเยี่ยม สนทนาและติดต่อทาง
หนังสือกับคนชาติของรัฐผู้ส่งที่ถูกคุมขังอยู่ 303
