หรือจิตใจ เพื่อให;ได;มาซึ่งข;อมูลหรือคำสารภาพจากผู;ถูกกระทำหรือบุคคลที่สาม เพื่อลงโทษจากการที่ผู;ถูกกระทำ

หรือบุคคลที่สามได;กระทำ หรือเพื่อข<มขู<หรือขู<เข็ญผู;ถูกกระทำหรือบุคคลที่สามเพราะเหตุแห<งการเลือกปฏิบัติโดย
ไม<เป_นธรรมทั้งปวง โดยที่การกระทำดังกล<าวได;กระทำโดย หรือด;วยการยุยง หรือโดยความยินยอม หรือรู;เห็นเป_น

ใจของเจ;าหน;าที่ของรัฐ หรือของบุคคลอื่นซึ่งปฏิบัติหน;าที่ในตำแหน<งทางการ ทั้งนี้ ไม<รวมถึงความเจ็บปวดหรือ
ความทุกข,ทรมานที่สอดคล;องกับการลงโทษโดยชอบด;วยกฎหมาย ซึ่งเป_นการวางหลักที่ครบองค,ประกอบที่
