of Rule of Law in the Thai political context for further development of
democracy in Thailand.
Issues for group discussion
1) Thai political culture that reinforces or undermines the
application of Rule of Law and has direct effects on the
quality of democracy in Thai society, including the patronage
system and unfair use of power. Other issues include the
Rule of Law and the opportunities for people’s politics.
2) Approaches to promote the Rule of Law based on Thai
culture.
3. The Rule of Law for Organizations Exercising State
Power: Interpretation, Scope of Power and Balancing?
All organizations that exercise state power, such as the
Parliament, the Cabinet, courts, constitutional organizations, as well as
government officials, are authorized to determine what is compliant with
or against the principles of the Rule of Law. The Constitutional Court
also has authority to make this determination, and its interpretation is
binding on all organizations. In the past, many decisions from the
Constitutional Court were derived from the interpretation of “the Rule of
Law”. Whether such decisions were to reject or confirm rights, they
also had impacts on various organizations and the society. Although the
Constitutional Court’s interpretation may be different from that of other
organization, it is considered the final decision. In several cases, such
decisions have been strongly criticized for contradicting the
interpretation of other organizations.
However, organizations exercising state power, including the
Constitutional Court, were established by the Constitution. Therefore,
