4. Human Rights and Civil Rights in the Process of
Judgment: Equal, Universal and Fair?

Many of Thailand’s constitutions have had provisions relating to
the Rule of Law and stipulate the minimum basic principles for the Rule
of Law. One of the basic principles is “The protection of human
dignity, rights, liberty, and equality.” This reflects universal and fair
justice in accordance with democracy. It includes the right to access
the judicial system in the case of conflict, both between people and

between people and the state. However, in reality, there are still some
problems concerning unequal access to the justice system. This is
particularly true when a party in dispute is poor and has limitations in
securing the help of capable lawyers, as well as the overly slow
process of judgment, which may bring about injustice. Therefore,
it is important to have a discussion about various problems concerning
the people’s access to the justice system to find solutions for these
problems. This will result in the recognition of the people’s right to have
access to the judicial process in accordance with the Rule of Law

provided in the Constitution as a part of human rights.

Issues for group discussion

1) Root causes of the problems that prevent people from getting
rights protection and access to the judicial process.

2) Case study of problems regarding access to the judicial
process for people in Thailand, with a case study on problems
arising during trials in any process of judgement.

3) Solutions and recommendations for problem solving so that
the people’s rights will be protected in the judicial system.
