มีการบัญญัติอยู่แล้วในประมวลกฎหมายอาญาไนจีเรีย (ทั้ง Penal
Code และ Criminal Code) ได้ โดยฐานความผิดที่ใกล้เคียงนั้น

ถูกจัดอยู่ในหมวด 31 (Chapter 31) “ฐานความผิดต่อเสรีภาพ
– การค้าทาส” (Offences against Liberty – Slave Dealing)
เป็นต้นว่า 1) การจำาคุกบุคคลอื่นโดยมิชอบด้วยกฎหมาย

เพื่อป้องกันมิให้บุคคลนั้นเข้าถึงกระบวนการยุติธรรมหรือ
ถูกค้นพบ และ 2) การคุมขังบุคคลอื่นโดยมิชอบด้วยกฎหมาย
