Act of 2017) มาตรา 2(1) วางหลักว่า การทรมาน คือ

การกระทำาที่เจตนาก่อให้เกิดความเจ็บปวดหรือความทุกข์ทรมาน

ไม่ว่าแก่กายหรือจิตใจ เพื่อให้ได้มาซึ่งข้อมูลหรือคำาสารภาพจาก
ผู้ถูกกระทำาหรือบุคคลที่สาม เพื่อลงโทษจากการที่ผู้ถูกกระทำา
หรือบุคคลที่สามได้กระทำา หรือเพื่อข่มขู่หรือขู่เข็ญผู้ถูกกระทำา

หรือบุคคลที่สามเพราะเหตุแห่งการเลือกปฏิบัติโดยไม่เป็นธรรม
ทั้งปวง โดยที่การกระทำาดังกล่าวได้กระทำาโดย หรือด้วยการยุยง

หรือโดยความยินยอม หรือรู้เห็นเป็นใจของเจ้าหน้าที่ของรัฐ หรือ
ของบุคคลอื่นซึ่งปฏิบัติหน้าที่ในตำาแหน่งทางการ ทั้งนี้ ไม่รวมถึง
ความเจ็บปวดหรือความทุกข์ทรมานที่สอดคล้องกับการลงโทษ

โดยชอบด้วยกฎหมาย ซึ่งเป็นการวางหลักที่ครบองค์ประกอบ

“Torture is deemed committed when an act by which pain or suffering,
whether physical or mental, is intentionally inflected on a person to –
(a) obtain information or a confession from him or a third person
(b) punish him for an act he or a third person has committed or is suspected
of having committed; or
(c) intimidate or coerce him or a third person for any reason based on
discrimination of any kind,
When such pain or suffering is inflicted by or at the instigation of or with
the consent or acquiescence of a public official or other person acting
in an official capacity provided that it does not include pain or suffering
in compliance with lawful sanctions.”
