The required attributes of genuine political impartiality and
integrity are crucial as they are factors that will directly affect the
extent to which the performance of duties of an Election Commissioner is
achieved. This will eventually influence the level of trust they gain from
the public, candidates and political parties, who are important sectors
for political stability in the representative democracy system.
(2) A lack of diversity in the process of selection and election of
the Election Commission in which the judicial branch plays a leading role.
The judicial branch plays a powerful and leading role and
in the process of selection and election of the Election Commission,
as five out of seven members of the Selection Committee for the
Election Commissioners are from the judicial branch whereas only
two members are from the political sector. Additionally, the Supreme
Court of Justice is entitled to consider and select two persons who are
suitable to be Election Commissioners for nomination to the Senate
through its President. If the Senate rejects all or some of the nominees,
the Selection Committee for the Election Commissioners or the General
Meeting of the Supreme Court of Justice may disagree with the rejection
by the Senate and resolve to reaffirm the original resolution with
unanimous vote of the Selection Committee for the Election Commissioners
or the votes of not less than two-thirds of the General Meeting of the
Supreme Court of Justice.
