CHALLENGES AND PERFORMANCE
To identify challenges and performance of the Election
Commission of Thailand, the following elements have been taken into
account: the main aim to establish the Election Commission as part of the
power structure of the country and the outcome, in reality, occurring as
a consequence of the performance of the Election Commission for nearly
20 years. The challenges and performance of the Election Commission
of Thailand can accordingly be identified as follows:
1. The ability to manage the elections to achieve the acquisition of
members of parliament as stipulated by the Constitution.
The Election Commission of Thailand not only holds the
authority and responsibility to enable honest and fair elections. It also has
executive, legislative, and quasi-judicial powers. These include the power
to adjudicate election disputes, to order re-election (yellow cards), and to
revoke the right of suffrage (red cards) to offending electoral candidates.
are within the authorities of the Election Commission. If the Commission
exercises its powers before the announcement of the election results,
the first paragraph of Article 239 of the Constitution also gave them the
authority of final judgment.
