The Election Commission shall decide and make its ruling under the laws
referred to in Article 237, 239, and 240 paragraph two, three, four and five.
7. To order a new election or a new voting at a referendum to
be held in any or all polling stations when there is convincing evidence
that the election or the voting at a referendum in that or those polling
stations did not proceed in an honest and fair manner.
8. To promote and support or coordinate with state agencies,
state enterprises, or local government organizations, or to support private
organizations in providing the public with education on the democratic
regime of government with the King as Head of the State as well as to
promote the public participation in politics.
The Election Commission who was in position under the 2007
Constitution had carried out the administrative and monitoring duties for
the General Election for the House of Representatives on 23 December
2007; the selection of senators in 2008, the process of which was shifted
from direct election of 200 senators stated in the 1997 Constitution; and
the General Election for the House of Representatives on 3 July 2011.
To sum up to this point, the Election Commission is an institution
under the power structure of the Thai State with the main aim to create
an honest, fair and legitimate means for candidates’ electoral competitions
to gain political positions. Their powers and duties include the election
and referendum administration and adjudication of disputes, as well as
political party related management, all of which are expected to be
efficiently and effectively accomplished in order to create honest and
fair elections.
