two parts as follows:
Part 1: Independent Organs under the Constitution, consisting
of Election Commission, Ombudsmen, the National Counter Corruption
Commission, and State Audit Commission
Part 2: Other Statutory Agencies, consisting of the Office of Public
Prosecutors, the National Human Rights Commission, and the National
Economic and Social Advisory Council
The number of Election Commissioners, including a Chairperson,
as specified in the 2007 Constitution, although was still kept at 5 persons,
the selection and appointment process was modified, as stated in Article
231 and 234. In addition, the specification of powers and duties of the
Election Commission was also altered. That is, although their fundamental
powers and duties were maintained, as stated in Article 235-240, there
were some shifts in how the Election Commissioners exercise their powers
and duties in investigation and adjudication of electoral disputes, which
are the crucial elements known as the power to give “yellow cards”
or “red cards” to offending players or electoral candidates, as follows:
1. to control and carry out the management of elections or
acquisition of members of the House of Representative, senators, local
council members, and local executives, as well as the management
of referendums in an honest and fair manner as stated in Article 235
paragraph one
2. to issue notifications and set rules prescribing all activities
necessary for the execution of the laws referred to in Article 235
paragraph two, including organic law on the election of members of the
House of Representatives and the acquisition of senators, organic law
