ASEAN Way has a ramification in the ASEAN political
40
culture and the constructivist justification. The component
41
of the ASEAN Way, as the regional mechanism, can be
investigated through ASEAN’s instruments. In this connection,
this paper considers an analysis on the legal mechanism of
the ASEAN Way that consists of two groups of principles:
(i) sovereignty and non-interference; and (ii) consensus and
flexibility.
The principles of sovereignty and non-interference
have been recognised in many ASEAN instruments. In this
regard, the nutshell of ASEAN cooperation was set forth in

Asia to bind themselves together in friendship and cooperation and, through
joint efforts and sacrifices, secure for their peoples and for posterity the
blessings of peace, freedom, and prosperity” See ASEAN Secretariat, The ASEAN
