and collaboration to reach the common goal which is public interest is
difficult to achieve. In addition, the traditional structure is inappropriate
for regulating and controlling the economic, social and information
technology related activities whose changes are affected by globalization.
Consequently, the research recommended adopting the mechanism
of “Independent Organization” which has been established in several
countries in the Constitution (Visanu Varunyou, 2538).
The initiation to establish a number of constitutional organizations
was adopted in the 1997 Constitution of Thailand (the People’s Constitution)
in favor of the political reform process. The Election Commission of
Thailand, one of the constitutional organizations, was mentioned in
Chapter 6 Part 8: Election Commission. The details can be categorized
into two main portions as follows:
The first portion prescribed the selection and election of
Chairperson and Election Commissioners, the composition of the Election
Commission, the qualifications and prohibition, and the protection of
independence of Election Commissioners as follows:
The Election Commission consists of a Chairperson and other
four Commissioners appointed, by the King with the advice of the Senate,
from persons of apparent political impartiality and integrity.
The selection and election of Chairperson and Election
Commissioners shall be proceeded as follows:
