complete number within fifteen days as from the date of the expiration
of the nomination time under (1);
(4) the elected persons under (3) shall meet and elect among
themselves Chairperson of the Election Commission and,
then, notify the President of the Senate of the result.
The President of the Senate shall report to the King for
further appointment.
In order to ensure political impartiality and independence of
Election Commissioners, the Constitution states that they shall hold
office for a term of seven years and shall serve for only one term. A special
compensation and welfare system was also adopted as a separated law
apart from the existing bureaucratic compensation law. This particular
law was promulgated as the Salary and Position Allowance and other
Compensations of the President of the Constitutional Court, Justices
of the Constitutional Court, Chairperson and Election Commissioners,
Chief Ombudsman and Ombudsmen, Chairperson and National Counter
Corruption Commissioners, Chairperson and State Audit Commissioners
Act, B.E. 2541 (1998). It was later amended in B.E. 2546 (2003) and 2555
(2012) respectively to suit the changes of the society.
In addition, Chapter 5 Directive Principles of Fundamental State
Policies, Article 75 paragraph two has been stipulated to ensure the
organizational independence in terms of budgeting of the Election
Commission as follows:
The State shall allocate adequate budgets for the independent
administration of the Election Commission, the Ombudsmen, the National
Human Rights Commission, the Constitutional Court, the Courts of Justice,
