Abstract
This research paper aims to examine the sports law in England, Japan
and the United State with a view to identify those areas for which legal
aspect of sports governance is of the greatest practical significant. Indeed,
in English, Japanese and the U.S. legal systems where sports laws are
already contained in their statutory laws, each sports regulatory framework
requires careful analysis as to how it can be best integrated and accord
with already established rules of the fair play in sporting competitions,
activities and practices. Sports law is an area of law that is intrinsically
linked to management of the modern sports industries and businesses.
It governs the sports stakeholders in which fair play are ensured that every
sports competitor has an equal chance of being successful in any given
competition, ultimately existing to allow sports authorities and the wider
sports governing bodies to function nationally and internationally.
A comparative legal study is made of the rules of national sports law
relating to society, economy and integrity, especially legal issues on national
jurisdictions. Despite of recent arrangement of sports regulatory frameworks
into a systematic written laws, for example, the Boxing Act B.E. 2542,
the Professional Sports Promotion Act, B.E. 2556, and the Sports Authority
of Thailand Act, B.E. 2558, there are few rules in this area. This study
goes some way towards filling this gap in the sports regulatory framework
in the Thai legal system. Comparative law methodology is used to find
solutions for legal problems of sports law in the foreign and Thai legal
systems. Its methods consist of a comparison of similar and different sports
law within national legal systems.
